Why it matters

Without a BOC-3, your authority stays inactive.

A BOC-3 names a process agent - the person legally allowed to accept court papers for you - in every state you operate. Until that designation is on file under 49 CFR §366, the FMCSA leaves your MC, MX, or FF authority switched off. No active authority means no loads, no insurance binder, no factoring.

As of 2026, operating without an active BOC-3 on file carries FMCSA civil penalties of at least $13,676 per violation, and new applicants have just 20 days from their FMCSA Register notice to file (BOC-3 required under 49 CFR §366; deadline under 49 CFR §365.109T).

You have 20 days. Under 49 CFR §365.109T, your BOC-3 must be on file within 20 days of the date your application notice is published in the FMCSA Register - the same window as your insurance filings. Miss it and the application is dismissed: you re-file and wait all over again. We submit the same business day, so the window is never the problem.
