Why do I need a BOC-3?

What carriers say.

“Responded to my question within minutes. Truly fast service unlike the DOT or FMCSA”
“Done same day thank you very much!”
“They filed my BOC-3 form very quickly. Less than 24 hours. No hassle from them or pressuring. I was actually recommended to use them from another customer. The price was very reasonable as well. Would recommend them to others in the future!”
“Super easy to file and a one time fee. Easy to switch from my existing provider who charged $50/year, $75 for life is a no brainer.”
“I had a great experience using this website to file my BOC-3. The process was quick, simple, and easy to understand, even for someone new to the paperwork. Everything was handled efficiently, and I received confirmation much faster than expected. The pricing was fair, and is a one-time fee with no annual charges or hidden costs. It made what could have been a complicated step feel smooth and stress-free.”
“Easiest filing I've ever done, cheapest service on the market by far...”

If FMCSA rejects your filing because of an error on our side, it is refiled free. If it still can’t be fixed, we refund your $75 (see our refund policy).

What is a BOC-3 filing?

A BOC-3 filing is FMCSA Form BOC-3, which names process agents who can accept legal papers for a motor carrier, broker or freight forwarder in each required state (49 CFR Part 366). A process agent files it for a carrier (FMCSA Form BOC-3 page).

Who needs a BOC-3?

Motor carriers, brokers and freight forwarders applying for FMCSA authority need a BOC-3. It names process agents who accept legal papers. Carriers need an agent in each state they operate in or cross; brokers need one where they have an office or write contracts (49 CFR 366.4T). FMCSA requires it before granting authority.

BOC-3 filing vs. your MC number, USDOT number and insurance

New authority takes four separate filings. Each does a different job, and a different party files each one.

FilingWhat it doesWho files it
USDOT numberIdentifies your company to FMCSAYou, when you register with FMCSA
MC or FF numberYour operating authority to haul or arrange freight for hire (49 CFR 365)You, in the same FMCSA application
BOC-3Names a process agent in every state to accept legal papers for you (49 CFR 366)A process agent (FMCSA Form BOC-3 page)

How a BOC-3 gets filed

  1. Get your USDOT number and apply for MC or FF authority in Motus.
  2. Order online with your USDOT or MC number.
  3. Your BOC-3 is filed electronically with FMCSA, naming a process agent in every state.
  4. FMCSA records the filing. It usually shows in FMCSA's Motus public search within about one business day, but FMCSA controls that timing.
  5. FMCSA activates your authority only after your insurance or bond is also on file and its review is finished.

Each step in detail: how to file a BOC-3.

Do freight brokers need a BOC-3?

Yes. Freight brokers need a BOC-3 on file before FMCSA grants broker authority. A broker must designate a process agent for each state where it has an office or writes contracts (49 CFR 366.4T(b)). Most brokers use a blanket company so one filing covers every state.

Do freight forwarders need a BOC-3?

Yes. A freight forwarder needs a BOC-3 on file before FMCSA grants its FF operating authority (49 U.S.C. 13304; 49 CFR Part 366). Owning no trucks doesn't remove the requirement. A forwarder that operates no trucks may file its own (FMCSA Form BOC-3 page), but most use a blanket company so one filing covers every state.

Do I need a BOC-3 for intrastate trucking?

Usually not. The BOC-3 is tied to FMCSA interstate operating authority. A carrier that stays inside one state and doesn't need an MC number generally doesn't file one, although its state may have its own rules. If you'll cross state lines for hire, you need operating authority and a BOC-3.

How do I change my BOC-3 process agent?

To change process agents, have the new agent file a new BOC-3. FMCSA treats the newest filing as the one on file, and it replaces the old designation (49 CFR 366.6T). You don't cancel the old one first. FMCSA charges nothing; you pay the new provider's fee.

How to check your BOC-3 is on file

Search your USDOT number in FMCSA’s Motus public search. No login is needed. A new BOC-3 usually shows there within about one business day of filing, but FMCSA controls that timing. SAFER’s Company Snapshot never shows the BOC-3, and the L&I system has been historical-only since May 14, 2026.

Step by step: how to check your BOC-3 status. To see where your authority stands, use our free MC number status checker.

What happens if your BOC-3 lapses

A BOC-3 doesn’t expire, but the designation can become invalid, for example if your process agent stops covering you. FMCSA may then issue an Order to Show Cause, which gives you 30 days to file a new BOC-3 before a final suspension order (FMCSA policy MC-RS-2019-0002).

The fix is a new BOC-3 filing. See how to switch process agents.
